Rider Rental Agreement

This Rider Rental Agreement ("Agreement") is a legally binding contract between Kick Ride PR LLC ("Kick Ride," "we," "us," or "our") and the individual accepting this Agreement ("Rider," "you," or "your"). By downloading the Kick Ride mobile application, unlocking, reserving, or operating any Kick Ride electric scooter ("Scooter"), you agree to be bound by this Agreement.

This Agreement applies exclusively within the Commonwealth of Puerto Rico.

1. Eligibility & Rider Responsibility

You represent and warrant that you are at least eighteen (18) years of age, are legally permitted to operate an electric scooter under Puerto Rico law, possess a valid, unexpired driver's license, and will comply with all applicable laws and municipal ordinances. You acknowledge that you are the sole operator of the Scooter for all legal and regulatory purposes.

2. Proper Use & Parking

You agree to operate the Scooter safely, prudently, and lawfully, and to comply at all times with all instructions, rules, prompts, maps, notifications, and requirements displayed in the Kick Ride mobile application.

Prohibited conduct includes, but is not limited to:

  • Operating a Scooter while under the influence of alcohol, drugs, or any impairing substance;
  • Allowing another person to operate a Scooter using your account;
  • Carrying passengers, towing objects, or using the Scooter for commercial purposes;
  • Tampering with, damaging, or modifying any Scooter or safety component;
  • Using a Scooter in a manner that endangers yourself or others.

You agree to park the Scooter legally, upright, and only in locations where parking is permitted, without obstructing sidewalks, pedestrian pathways, curb ramps, entrances, public access points, private property, or the safe passage of pedestrians, including individuals using wheelchairs, strollers, walkers, or other mobility or assistive devices.

Improper parking or operation may result in fines, citations, impoundment, administrative penalties, or additional fees, for which you are fully responsible.

3. Fines, Citations & Enforcement Actions

You are solely responsible for all fines, penalties, citations, tickets, towing charges, impound fees, storage fees, and administrative costs arising from your use, operation, or parking of a Scooter. This includes citations issued by law enforcement, municipal authorities, park rangers, DTOP, or other governmental agencies.

Kick Ride may transmit notice of any citation, pay such fines on your behalf, and charge your stored payment method for the full amount of such fines plus a service processing fee. You expressly authorize all such charges.

4. Payment Authorization

You authorize Kick Ride to charge your stored payment method for ride fees, applicable taxes, damage or loss, vandalism, misuse, excessive cleaning, fines, enforcement-related fees, towing, impoundment, recovery, storage, administrative, and processing fees.

Failure to maintain a valid payment method may result in suspension, termination, or collection actions.

5. Assumption of Risk

Scooters are provided "AS IS" and "AS AVAILABLE." Kick Ride makes no representations or warranties regarding condition, availability, performance, or uninterrupted operation.

You acknowledge that electric scooter use involves inherent risks and voluntarily assume all risks associated with your use of a Scooter, whether foreseeable or unforeseeable.

6. Safety Equipment & No Insurance

You are solely responsible for the use of safety equipment, including helmets or protective gear. Kick Ride does not guarantee that safety equipment will be provided.

Kick Ride does not provide medical, health, personal injury, liability, or accident insurance coverage. Your personal insurance may not cover scooter use.

7. Release of Liability

To the maximum extent permitted by Puerto Rico law, you release and discharge Kick Ride PR LLC, its owners, officers, employees, contractors, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities arising from or related to your use of a Scooter, including claims arising from equipment condition, third-party conduct, or actions or omissions of law enforcement, governmental authorities, municipalities, park authorities, or other regulatory or enforcement agencies.

8. Indemnification

You agree to indemnify, defend, and hold harmless Kick Ride PR LLC from all claims, fines, penalties, damages, losses, costs, and expenses, including attorneys' fees, arising from your violation of law, improper operation or parking, or third-party claims caused by your conduct.

9. Limitation of Liability

Kick Ride's total liability for any claim arising out of or related to this Agreement shall not exceed the total ride fees paid by you in the twelve (12) months preceding the event giving rise to the claim. Kick Ride shall not be liable for indirect, incidental, consequential, or punitive damages.

10. Dispute Resolution & Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Puerto Rico. Any dispute shall, at Kick Ride's election, be resolved exclusively in Puerto Rico courts or through binding arbitration administered by the American Arbitration Association (AAA), seated in Puerto Rico.

11. Termination

Kick Ride may suspend or terminate your account at any time for violations of this Agreement, unsafe behavior, non-payment, misrepresentation, or regulatory compliance reasons.

12. Photo Verification, GPS & Monitoring

Scooters may be equipped with GPS or monitoring technology. Kick Ride may collect ride data, location data, and require photo verification for parking, enforcement, billing, compliance, and dispute resolution.

13. Misrepresentation

Any false, misleading, or incomplete information provided by you constitutes a material breach of this Agreement.

14. Force Majeure, No Bailment & Subrogation

Kick Ride shall not be liable for delays or service interruptions caused by governmental action, emergencies, weather, or events beyond its control. No bailment or ownership interest is created. All Scooters remain Kick Ride property. You waive any right of subrogation against Kick Ride.

15. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

This Agreement constitutes the entire agreement between you and Kick Ride regarding scooter use.
