Rental Agreement

This Rental Agreement (the “Agreement”) governs your use of Kick Ride electric scooters and related services (“Services”) provided through the Kick Ride mobile application (the “App”). By creating an account, unlocking, or riding a Kick Ride scooter, you agree to this Agreement and our Privacy Policy.
1. Independent Operator Notice
Kick Ride PR LLC (“Kick Ride PR”) operates the App, payment systems, and customer support infrastructure for all users. However, scooters may be operated by independent licensed partners in certain territories.
• In Puerto Rico, scooters are operated directly by Kick Ride PR LLC.
• In The Bahamas, scooters are operated by Breeze Micromobility Rideshare Co. Ltd., an independent licensee of Kick Ride PR LLC (“Breeze”).
Breeze Micromobility is solely responsible for the operation, maintenance, and safety of the local fleet in The Bahamas. Kick Ride PR LLC provides only the technology platform, payment processing, and customer support, and is not the fleet operator in that territory.
2. Eligibility and Rider Requirements
You must be at least 18 years old and possess a valid driver’s license. You agree to comply with all applicable local traffic and safety laws. You are the sole rider of any scooter you unlock—no passengers permitted. You may not operate a scooter while under the influence of alcohol, drugs, or any substance that impairs safe operation.
3. Fees and Payments
Ride fees, unlock fees, and applicable taxes are displayed in the App before the ride starts. Payments are processed through Kick Ride PR’s App platform. All transactions in The Bahamas are processed through Kick Ride PR on behalf of Breeze Micromobility. By starting a ride, you authorize Kick Ride PR to charge your stored payment method for all fees, fines, and adjustments related to your ride.
4. Use of Scooters
You agree to visually inspect each scooter before riding. Do not ride any scooter that appears damaged, defective, or unsafe. You must park scooters responsibly and in accordance with local laws. You are responsible for any scooter in your possession until the ride is properly ended in the App. If a scooter is lost, stolen, or damaged while under your control, you may be charged repair or replacement costs.
5. Data and Privacy
Kick Ride PR collects and processes user, payment, and ride data as described in our Privacy Policy. In The Bahamas, operational data related to scooter maintenance or fleet management may also be shared with Breeze Micromobility Rideshare Co. Ltd. for compliance and safety purposes, under strict data-processing safeguards consistent with the Kick Ride Privacy Policy. All user account and payment data are securely stored on servers located outside The Bahamas, managed by Kick Ride PR LLC. Breeze Micromobility Rideshare Co. Ltd. does not store or process user payment data locally and may access only the limited operational data necessary to perform fleet maintenance and compliance duties.
6. Assumption of Risk and Limitation of Liability
You acknowledge that riding an electric scooter involves inherent risks, including the risk of injury, death, or property damage.
By unlocking or operating a Kick Ride scooter, you agree to do so at your own risk and accept full and sole responsibility for the safe and lawful operation of the vehicle.
Rider Responsibility:
You are solely responsible for:
● Operating the scooter in a safe and compliant manner;
● Any injury, loss, or damage you cause to yourself, pedestrians, property, or third parties; and
● Understanding and obeying all applicable traffic, parking, and safety laws.
In Puerto Rico: Kick Ride PR LLC is the fleet operator and shall not be liable for any loss, injury, or damage arising from your use of a scooter except where such loss or damage is caused by Kick Ride PR LLC’s gross negligence or willful misconduct.
In The Bahamas: Breeze Micromobility Rideshare Co. Ltd. is the sole operator of the fleet. Kick Ride PR LLC provides only the technology platform, app, and payment services, and assumes no responsibility or liability for any injury, loss, or damage arising from scooter operation or maintenance in The Bahamas.
To the fullest extent permitted by law, you release and agree to hold harmless Kick Ride PR LLC, Breeze Micromobility Rideshare Co. Ltd., and their respective officers, employees, and affiliates from any claims, demands, or damages of any kind arising from or related to your use of the Services.
7. Insurance
Riders are responsible for determining whether their personal insurance policies cover electric scooter use.
8. Refunds and Disputes
Refunds, account issues, and payment disputes are handled directly by Kick Ride PR LLC, regardless of where the ride occurred. Breeze Micromobility provides on-the-ground support as directed by Kick Ride PR. All refund requests must be submitted through the App or via support@kickride.co within 5 days of the ride.
9. Termination of Use
Kick Ride PR may suspend or terminate your access for violations of this Agreement, misconduct, or non-payment. If your account is terminated, any outstanding charges remain payable.
10. Governing Law and Dispute Resolution
For rides in Puerto Rico:
This Agreement is governed by the laws of the Commonwealth of Puerto Rico.
Disputes shall be resolved through binding arbitration in San Juan between the rider and Kick Ride PR LLC.
For rides in The Bahamas:
This Agreement is governed by the laws of The Bahamas.
Disputes related to rides operated in The Bahamas shall be resolved between the rider and Breeze Micromobility Rideshare Co. Ltd., the licensed operator, through arbitration or in the courts of Nassau, The Bahamas.
Kick Ride PR LLC is not a party to any local dispute arising from the operation, maintenance, or condition of the fleet.
11. Miscellaneous
This Agreement, along with our Privacy Policy, represents the entire understanding between you and Kick Ride PR LLC. If any provision is found unenforceable, the remainder shall continue in effect. Kick Ride PR reserves the right to modify these Terms at any time. Updated versions will be posted in the App and on the website.
11.1 Force Majeure:
Neither Kick Ride PR LLC nor any of its licensed operators, including Breeze Micromobility Rideshare Co. Ltd., shall be held liable for any delay or failure to perform obligations under this Agreement if such delay or failure results from causes beyond their reasonable control, including but not limited to natural disasters, severe weather, power or network outages, labor disputes, civil unrest, acts of war, or governmental restrictions.
Annex A – Puerto Rico
Kick Ride PR LLC operates and maintains the fleet in San Juan, Condado, Santurce, Hato Rey, and Río Piedras. Riders agree to comply with Puerto Rican traffic and safety laws, including all helmet and parking requirements.
Disputes arising under this Agreement for rides in Puerto Rico shall be governed by the laws of the Commonwealth of Puerto Rico and resolved through binding arbitration in San Juan.
Annex B – The Bahamas
The Bahamas fleet is operated by Breeze Micromobility Rideshare Co. Ltd., under license from Kick Ride PR LLC. Riders must be 18+ and wear helmets as required by Bahamian law. Breeze Micromobility is solely responsible for fleet operation, safety, and maintenance. Kick Ride PR provides app functionality, payments, and customer support but is not the operator.
Data collected during rides in The Bahamas may be shared with Breeze solely for compliance and maintenance purposes. Liability: Breeze bears full operational responsibility. Kick Ride PR is not liable for accidents, injuries, or operational issues within The Bahamas. Disputes for rides in The Bahamas shall be resolved in accordance with Bahamian law.
No Agency or Partnership:
Breeze Micromobility Rideshare Co. Ltd. operates as an independent licensee and is not an employee, partner, agent, or legal representative of Kick Ride PR LLC. Nothing in this Agreement shall be construed to create a joint venture, partnership, or agency relationship between the parties.
